Paragraph (a) of subdivision 2 of section 391-m of the 2 general business law, as added by chapter 16 of the laws of 1996, is 3 amended to read as follows: 4 (a) No person, firm, corporation, or other legal entity which manufac- 5 tures or assembles in-line skates shall manufacture, assemble, sell, 6 offer to sell, or distribute in this state such in-line skates unless: 7 (i) at least one such in-line skate in each pair manufactured or assem- 8 bled is manufactured or assembled with a brake, as defined in this 9 section; and{,} (ii) at least one such in-line skate in each pair manu- 10 factured or assembled contains a warning instruction, as defined in this 11 section, either on at least one such in-line skate in each pair or on 12 the outside of the box in which such pair of in-line skates is sold or 13 offered for sale at retail; and{,} (iii) each such pair of in-line 14 skates which contains a user`s guide or buyer`s instruction manual also 15 contains a warning instruction, as defined in this section, within or on 16 such guide or manual; AND, (IV) EVERY IN-LINE SKATE IS EQUIPPED WITH A 17 REFLECTIVE DEVICE OR MATERIAL MEETING THE STANDARDS ESTABLISHED BY RULES 18 AND REGULATIONS PROMULGATED BY THE COMMISSIONER OF MOTOR VEHICLES. Each 19 pair of in-line skates which is manufactured or assembled by a person, EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets { } is old law to be omitted. LBD09080-03-9 A. 5912--A 2 1 firm, corporation, or other legal entity for special use by highly 2 skilled or expert skaters or for sale or distribution through custom 3 orders are exempt from the requirements of item (i) of this paragraph, 4 provided that such person, firm, corporation or other legal entity which 5 manufactures or assembles such pair of in-line skates clearly and 6 conspicuously labels at least one in-line skate in each such pair of 7 in-line skates or the outside of the box in which such pair of in-line 8 skates is sold or offered for sale at retail with the following warning 9 in substantially the following form: "WARNING: THESE IN-LINE SKATES 10 CONTAIN NO BRAKES AND ARE INTENDED FOR HIGHLY SKILLED OR EXPERT SKATERS 11 ONLY". 12 S 2. The vehicle and traffic law is amended by adding a new section 13 1239 to read as follows: 14 S 1239. REFLECTIVE MATERIAL AND DEVICES FOR IN-LINE SKATING. THE 15 COMMISSIONER IS HEREBY DIRECTED TO PROMULGATE RULES AND REGULATIONS TO 16 ESTABLISH STANDARDS FOR REFLECTIVE DEVICES AND/OR MATERIAL TO BE 17 EQUIPPED INTO IN-LINE SKATES PURSUANT TO SECTION THREE HUNDRED 18 NINETY-ONE-M OF THE GENERAL BUSINESS LAW. 19 S 3. This act shall take effect 1 year after it shall have become a 20 law; provided, however, that effective immediately, the addition, amend- 21 ment and/or repeal of any rules or regulations necessary for the imple- 22 mentation of the foregoing sections of this act on its effective date is 23 authorized and directed to be made and completed on or before such 24 effective date. .SO DOC A 5912A *END* BTXT 1999
